A. Withdrawal Instructions

Introduction

Consumers have a statutory right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, have taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (Clever Solutions International GmbH, Bärengässchen 6 Top 5, 5020 Salzburg, Austria, Tel.: +436641847264, Email: orders@nomad-secrets.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

You may also exercise your right of withdrawal online via the website at the following internet address: https://nomad-secrets.com/apps/retractly/withdraw. If you use this online option, we will immediately send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including information about the content of the withdrawal statement as well as the date and time of its receipt.

To comply with the withdrawal period, it is sufficient for you to send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments we have received from you, including the costs of delivery (with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from the handling of the goods beyond what is necessary to establish their nature, characteristics and functioning.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal shall expire prematurely in the case of contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.

The right of withdrawal shall not apply to consumers who, at the time the contract is concluded, do not belong to a Member State of the European Union and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

General Information

  1. Please avoid damaging or contaminating the goods. Please return the goods to us in their original packaging, including all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using suitable packaging.

  2. Please do not return the goods to us carriage forward or with postage unpaid.

  3. Please note that the above points 1–2 are not a prerequisite for the effective exercise of the right of withdrawal.
